My account had no money in it and I attempted to pay capital one. The payment was returned and therefore was never paid to capital one however the charge did remain on my account and resulted in acquiring other fees. How can I get this matter resolved to open another account with TD

As you have a charged off account previously with us, we recommend paying off the overdrawn balance first prior opening your new account.

Once you are on the phone with them, they can confirm the exact amount you owed and also provide you with payment options.
