I have some sort of plan on my debit card that allows me to take out money even when the account is sometimes overdrawn. How does that work and who determines when the card works?

It sounds like you've enrolled in TD Debit Card Advance. We'd be glad to explain how it works.
With this program, overdraft availability is determined electronically at the time that your card is swiped or process. Some factors for acceptance are: the age of your account, the balance in the account, and the past number of overdraft occurrences. The longer your account is open and remains at a positive balance, the more likely your transactions will be approved when you really need it. If you attempt a purchase and the debit card declines, it may mean that you've met the discretionary limit the bank will allow at that time.
If you make a purchase or ATM withdrawal that overdrafts your account, you may be charged an overdraft fee. You may overdraft your account by up to $5.00 before a fee would be applied. After that, you may be charged for each transaction that overdrafts your account. We will not charge more than 5 overdraft fees per day.
