we have joint checks made out to us, though my name change is in process - can we use these checks to open an account?

When you are ready to open a joint account, both parties must be present at the time of the account opening and can visit any TD Bank Store. For locations and hours near you, please visit: http://bit.ly/1dOroWV. The name on your Driver’s License, State issued photo I.D., or passport is the name that must be listed on the new account. You can use any of these items of Identification when opening the account. If or when you change your last name on your Identification, you can request the name change additionally on your Savings Account.
You are also welcome to open an individual account online at: http://bit.ly/PnWJZJ or you could even call us at 888-751-9000 24/7. Once your individual account has successfully opened, you can then visit any local TD Bank Store with your husband to add him onto your account.
