I ate at a resturant. I signed a credit card receipt for $31.17. I just looked at my account and they processed the charge as $77.75. This is the wrong amount. I did not add an extra tip to the check because it was take-out. I called the restaurant they are not being helpful. In addtion, this over charged caused my account to be overdrawn.
Who should fix this the restaurant or place a claim with TD Bank. Who will cover my overdraft fees?

Sorry to hear about any difficulties Q but thanks for reaching out to us. We'll be glad to advise you further in this instance.
First, we'd like to reassure you that in the event of any trouble with a merchant, we're here to assist you.
Before filing a dispute through TD Bank to recover your funds, we ask that you get in touch with the restaurant to determine if they'll refund your account. It's necessary to check with the merchant for the possibility of a refund before filing a claim with TD Bank.
Once you attempt to resolve this with them, or since it sounds like you may have already done so, if they are unable or unwilling to provide a refund to you, you can then dispute the item with us. If the charge was made via your TD Visa Debit card, you're welcome to give us a call 24/7 at 888-751-9000 to do so, or stop in at any TD Bank Store found here http://bit.ly/TDStores for assistance. When filing a claim, we recommend taking note of who you may have spoken with, the date, and any other information that may be relevant so that we can include it on your claim. Or, if the charge was made with your TD Visa Credit card, you're welcome to call 888-561-8861 for assistance. At the conclusion of the claim, more information may be provided as to how you may recover the funds from any overdraft fees paid.
We hope this information helps, Q and best of luck with the claim process. Take care.
